Thanks for explaining this clearly. 2 Questions:
1. If you use EAD and don't file AC21 and assume your I140 is revoked and USCIS wrongly denies I485 based on the I140 revocation, will you be on legal status while you fight the USCIS ?
filing of MTR does not give you status, once they accept it, yes you are in status again.
2. If you do file for AC21 and switch jobs, if you happen to change jobs again, do you have to file for AC21 again? Does this need to happen everytime one switches jobs?
yes. You are basically keeping USCIS updated with the information of an emplpoyer who is willing to hire you once you get your GC.

I was wondering if update is only available through state chapter? If so we are in blackhole,,, as many of us are not members of state chapter..

No one analysed the statue of the language used in 202 5 a.

Anyway, that paragraph also states: "If the total number of visas available under paragraph (1), (2), (3), (4), or (5) [...] exceeds the number of qualified immigrants who may otherwise issued such visas,." but then continues on with: "the visas made available under that paragraph shall be issued without regard to the numerical limitation"
One could interpret this distinction such that the actual number of visas available is not necessarily the same number of visas made available, which is fixed to 28.6% + spill-over. It might, as well, comprise only those unused visas that haven't been passed down to a lower category. 203 (b) (2) / (3) and 202(5) seem to compete over the unused numbers. Not sure which one has preference.

From their tone, I can tell the were trying hard to be helpful.
But, no receipt for me yet. July 2nd filer here as well.
Should I keep another set of 485 application ready, just in case if I don't hear about check cashing or receipt till august 15th ?
Is there any harm in filing the 485 again (just to be safe).... IF I don't get any indication of action on july2nd app ?

When is the December visa bulletin coming? Can someone ask their lawyer?
Why is nobody predicting? Are we all becoming so pessimistic?
waitingnwaiting, you're probably new here, so just a tip - nowadays the topic of visa bulletin is not very popular.
A couple of reasons for that, people are frustrated by the slow movement, a bulk of the old timers have their dates current and finally Oppenheimer gave a forecast of what to expect over the next few months - which is movement every month by a couple of weeks at the most.
So the whole guessing game of visa bulletin doesn't interest anyone anymore. Our only hope, especially for EB3, but also for EB2 is to meet our lawmakers on a regular basis and push our agenda for legislative change. Other than that, we are looking at years and years of waiting.
My suggestion to you is to become a donor at IV, join your local State chapter and start meeting lawmakers. Hope this helps. Cheers!

I spoke to a staff at Michael R. McNulty's office.
He comes to Albany on weekends only.
Rest of the time (5 days a week) he is in Washington.
We can meet staff members any time betwenn 9 to 5 (no appointment required).
Spoke to staff member at Schumer's office.
He is not available for a meeting.
Have set up a meeting (with staff) for 12th April 11am (nothing available for next 2 weeks).
I was actually just trying to find out if we could schedule an appointment with Schumer. Did not expect them to set up an appointment on the phone so fast.
We can change if this is not convenient.
I am not sure if this is gonna help, as it is 2 weeks away.

If Republicans control the House, they will be too bitter because they can't repeal the Health Care Reform, and will not let CIR pass in 2011. Best hope is 2012 now. Obama could have easily passed CIR in past 2 years, instead he focused all his efforts on health care..

Leave on good terms with your current employer. If that's not possible and you have a good reason to believe that they'll withdraw I-140, conduct a pre-emptive strike and file AC21 papers with the USCIS (a new employment offer listing job title, duties, salary). That will eliminate or at least minimize a headache associated with I-140 withdrawal. Employer is free to withdraw I-140 at any time and the USCIS cannot prohibit it. However, even if I-140 is withdrawn, your I-485 remains valid if you have a new employment offer. So no worries, just plan for it and act according to your gut feeling :)

If I were you, I would discuss this before the wedding. Its too important an issue not to disclose, in my opinion.

Its very very important to discuss this with your future wife. If your marriage starts with telling a lie, IMO, its not a good sign. Whether its good or bad, just talk to her and discuss the best available option. If she is really understanding and supportive of the decision you both make, then you have already started your marriage life with flying colors...:)
And BTW, if you are considering reentry permit (to be out of US for more than allowed time on PR) NEVER APPLY REENTRY PERMIT WHILE YOU ARE OUTSIDE THE U.S. IT'S GONNA BE DENIED AND THE APPEAL WILL ALSO BE DENIED...And you will be stuck outside U.S. with a PR...

I am not with them anymore, I transfered my H1 to another company already. i just need to find out the way how to file a complaint and proceed further.
That's good to know that you transferred your H1-B.
As people already suggested there are very slim chances you can do anything about this, since labor and I-140 belongs the the employer. So if you can prove with written statements from your employer that he will sponsor your GC and if can prove that have incurred monetary loss, you might be able to get something out of this.
On a side note, You may want to see if there is any other options to bring him down, such as if you were on H1-B and if your employer did not pay you the salary he promised. This definitely will put him on the black list and he cannot hire anybody else on H1-B. All the best!

I dont think DOS will do any spillover, if by a miracle they do a quarterly spillover it can happen only in december, The whole idea of spillover is if there are any leftover visas they have to use it by the end of the year (i.e spetember 30) or if they do quarterly spillover as the law says then they have to do it by the end of the quarter i.e Dec 31, march 31, June 30.
If the eb2 does not move to atleast march 2005 then it means DOS is not doing quarterly spillover.
I don't have any high hope. I am guessing that Mr Oppenheim will do quarterly spill over of first quarter into first month of second quarter. So Lets wait for Jan bulletin..
